GuestBuddy koristi umjetnu inteligenciju (AI) za generiranje odgovora. AI tehnologija ima inherentna ograničenja i može generirati netočne, nepotpune ili neodgovarajuće informacije. Korištenjem ove usluge prihvaćate ta ograničenja i preuzimate odgovornost za provjeru svih informacija.

1. Prihvaćanje uvjeta

Kreiranjem računa ili korištenjem GuestBuddy platforme, prihvaćate ove Uvjete korištenja i našu Politiku privatnosti. Ako se ne slažete, molimo vas da ne koristite našu uslugu.

2. Opis usluge

GuestBuddy pruža AI chatbot uslugu za smještajne objekte. Naša usluga uključuje:

  • Prilagodljive AI chatbotove za komunikaciju s gostima
  • Digitalne obrasce za prijavu gostiju
  • Podršku za više jezika
  • Upravljačku ploču za vlasnike smještaja
  • Integraciju s eVisitor sustavom (opcionalno)

3. Priroda AI usluge

GuestBuddy koristi naprednu AI tehnologiju za generiranje odgovora gostima. Međutim, važno je razumjeti:

  • AI generira odgovore na temelju informacija koje vi unesete u sustav
  • AI NIJE svjestan stvarnog stanja - ne zna jesu li stvari na mjestu, radi li klima, ima li tople vode, itd.
  • AI može "halucinirati" - generirati informacije koje zvuče uvjerljivo ali nisu točne
  • AI ne može zamijeniti ljudsku provjeru i komunikaciju
  • Kvaliteta odgovora ovisi o kvaliteti podataka koje vi unesete

4. ODRICANJE OD ODGOVORNOSTI ZA AI ODGOVORE

GuestBuddy d.o.o. ("Pružatelj usluge") NE GARANTIRA točnost, potpunost, prikladnost ili pouzdanost odgovora koje generira AI sustav.

AI može generirati netočne, nepotpune, zastarjele ili neodgovarajuće informacije. Pružatelj usluge se IZRIČITO ODRIČE SVAKE ODGOVORNOSTI za:

  • Netočne informacije o smještaju, cijenama, dostupnosti ili uvjetima
  • Pogrešne upute ili preporuke dane gostima
  • Bilo kakvu štetu nastalu uslijed oslanjanja na AI-generirane odgovore
  • Propuštene rezervacije, nezadovoljstvo gostiju ili negativne recenzije
  • Kršenje lokalnih zakona ili propisa zbog netočnih informacija
  • Financijske gubitke bilo koje vrste
  • Narušavanje ugleda vašeg smještajnog objekta

5. Vaša odgovornost kao korisnika

Vi, kao korisnik platforme i vlasnik/upravitelj smještajnog objekta, preuzimate PUNU ODGOVORNOST za:

  • Točnost, potpunost i ažurnost svih informacija koje unesete u sustav
  • Redovito ažuriranje informacija o smještaju (cijene, dostupnost, pravila)
  • Provjeru da AI odgovori odgovaraju stvarnom stanju vašeg objekta
  • Povremeno testiranje chatbota kako biste osigurali kvalitetu odgovora
  • Pružanje točnih kontakt informacija gostima za hitne slučajeve
  • Usklađenost s lokalnim zakonima o smještaju i turizmu
  • Obradu i zaštitu osobnih podataka gostiju u skladu s GDPR-om

6. Ograničenje odgovornosti

U najvećoj mjeri dopuštenoj primjenjivim zakonima:

  • Pružatelj usluge NI U KOJEM SLUČAJU neće biti odgovoran za bilo kakvu neizravnu, slučajnu, posebnu, posljedičnu ili kaznenu štetu
  • Ukupna odgovornost Pružatelja usluge ograničena je na iznos koji ste platili za uslugu u posljednjih 12 mjeseci
  • Ova ograničenja primjenjuju se čak i ako je Pružatelj usluge bio obaviješten o mogućnosti takvih šteta

7. eVisitor integracija

Ako koristite eVisitor integraciju za prijavu turista hrvatskim vlastima:

Vi ste ISKLJUČIVO ODGOVORNI za:

  • Točnost podataka koji se šalju sustavu eVisitor
  • Pravovremenu prijavu svih gostiju u skladu sa zakonskim rokovima
  • Provjeru da su podaci uspješno poslani i registrirani
  • Ručnu prijavu u slučaju tehničkih problema s integracijom

Pružatelj usluge NE PREUZIMA ODGOVORNOST za eventualne kazne, sankcije ili druge posljedice proizašle iz netočnih, nepotpunih ili zakašnjelih prijava turista.

8. Registracija računa

Za korištenje naše usluge morate:

  • Imati najmanje 18 godina
  • Pružiti točne i potpune podatke pri registraciji
  • Održavati sigurnost svojih pristupnih podataka
  • Odmah nas obavijestiti o neovlaštenom pristupu računu

9. Pretplata i plaćanja

  • 14 dana besplatno: Novi korisnici dobivaju 14 dana besplatnog testiranja s punom funkcionalnosti. Kartica se unosi pri registraciji ali se ne tereti tijekom trial perioda.
  • Naplata: Pretplate se naplaćuju mjesečno ili godišnje prema odabiru
  • Automatsko obnavljanje: Pretplate se automatski obnavljaju osim ako nisu otkazane
  • Povrati: Nudimo 14-dnevnu garanciju povrata novca za nove pretplatnike
  • Promjene cijena: O povećanju cijena obavijestit ćemo vas 30 dana unaprijed

10. Prihvatljiva upotreba

Slažete se da NEĆETE koristiti GuestBuddy za:

  • Kršenje bilo kojih zakona ili propisa
  • Prenošenje štetnog, uvredljivog ili obmanjujućeg sadržaja
  • Lažno predstavljanje ili pružanje lažnih informacija
  • Pokušaj neovlaštenog pristupa našim sustavima
  • Korištenje usluge za spam ili neželjenu komunikaciju
  • Obrnuti inženjering ili pokušaj izvlačenja izvornog koda

11. Vlasništvo nad sadržajem

  • Vaš sadržaj: Zadržavate vlasništvo nad informacijama o objektu i sadržajem koji pružate
  • Licenca nama: Dajete nam licencu za korištenje vašeg sadržaja radi pružanja naših usluga
  • Naš sadržaj: GuestBuddy, njegov logo i dizajn usluge su naše intelektualno vlasništvo

12. Podaci gostiju i usklađenost

Ako prikupljate podatke gostiju putem naših obrazaca za prijavu:

  • Odgovorni ste za usklađenost s lokalnim zakonima o prijavi gostiju
  • Morate imati zakonitu osnovu za prikupljanje i obradu podataka gostiju
  • Morate obavijestiti goste o načinu korištenja njihovih podataka
  • Mi djelujemo kao obrađivač podataka u vaše ime

13. Dostupnost usluge

Nastojimo održati 99.9% dostupnosti, ali ne garantiramo neprekidnu uslugu. Možemo:

  • Provoditi planirano održavanje uz prethodnu najavu
  • Privremeno obustaviti uslugu radi hitnog održavanja
  • Izmijeniti ili ukinuti značajke uz razuman rok najave

14. Raskid

Možete otkazati pretplatu u bilo kojem trenutku. Mi možemo suspendirati ili ukinuti vaš račun ako:

  • Prekršite ove Uvjete korištenja
  • Ne platite pretplatničke naknade
  • Sudjelujete u prijevarnim ili štetnim aktivnostima

15. Mjerodavno pravo

Ovi Uvjeti podliježu zakonima Republike Hrvatske. Svi sporovi rješavat će se pred nadležnim sudovima u Hrvatskoj, osim ako propisi o zaštiti potrošača u vašoj jurisdikciji ne zahtijevaju drugačije.

16. Izmjene uvjeta

Možemo povremeno ažurirati ove Uvjete. O materijalnim promjenama obavijestit ćemo vas putem e-pošte ili putem naše usluge. Nastavak korištenja nakon promjena predstavlja prihvaćanje.

17. Prihvaćanje uvjeta

Kreiranjem chatbota potvrđujete da ste pročitali, razumjeli i u potpunosti prihvatili ove uvjete korištenja.

Ako se ne slažete s bilo kojim dijelom ovih uvjeta, nemojte koristiti uslugu.

GuestBuddy uses artificial intelligence (AI) to generate responses. AI technology has inherent limitations and may generate inaccurate, incomplete, or inappropriate information. By using this service, you accept these limitations and assume responsibility for verifying all information.

1. Acceptance of Terms

By creating an account or using GuestBuddy, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use our service.

2. Description of Service

GuestBuddy provides an AI-powered chatbot service for vacation rental properties. Our service includes:

  • Customizable AI chatbots for guest communication
  • Digital guest check-in forms
  • Multi-language support
  • Property management dashboard
  • eVisitor integration (optional - Croatian tourist registration)

3. Nature of AI Service

GuestBuddy uses advanced AI technology to generate responses to guests. However, it is important to understand:

  • AI generates responses based on information you enter into the system
  • AI is NOT aware of actual conditions - it doesn't know if things are in place, if AC works, if there's hot water, etc.
  • AI can "hallucinate" - generate information that sounds convincing but is not accurate
  • AI cannot replace human verification and communication
  • Response quality depends on the quality of data you provide

4. DISCLAIMER FOR AI RESPONSES

GuestBuddy Ltd. ("Service Provider") DOES NOT GUARANTEE the accuracy, completeness, suitability, or reliability of AI-generated responses.

AI may generate inaccurate, incomplete, outdated, or inappropriate information. The Service Provider EXPRESSLY DISCLAIMS ALL LIABILITY for:

  • Inaccurate information about accommodation, prices, availability, or conditions
  • Incorrect directions or recommendations given to guests
  • Any damage arising from reliance on AI-generated responses
  • Missed bookings, guest dissatisfaction, or negative reviews
  • Violation of local laws or regulations due to inaccurate information
  • Financial losses of any kind
  • Damage to the reputation of your accommodation

5. Your Responsibility as a User

You, as a platform user and property owner/manager, assume FULL RESPONSIBILITY for:

  • Accuracy, completeness, and currency of all information you enter into the system
  • Regularly updating accommodation information (prices, availability, rules)
  • Verifying that AI responses correspond to the actual condition of your property
  • Periodically testing the chatbot to ensure response quality
  • Providing accurate contact information to guests for emergencies
  • Compliance with local accommodation and tourism laws
  • Processing and protecting guest personal data in accordance with GDPR

6. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service Provider shall IN NO EVENT be liable for any indirect, incidental, special, consequential, or punitive damages
  • The Service Provider's total liability is limited to the amount you paid for the service in the last 12 months
  • These limitations apply even if the Service Provider was advised of the possibility of such damages

7. eVisitor Integration

If you use the eVisitor integration for registering tourists with Croatian authorities:

YOU ARE SOLELY RESPONSIBLE for:

  • Accuracy of data sent to the eVisitor system
  • Timely registration of all guests in accordance with legal deadlines
  • Verifying that data was successfully sent and registered
  • Manual registration in case of technical problems with the integration

The Service Provider ASSUMES NO LIABILITY for any fines, sanctions, or other consequences arising from inaccurate, incomplete, or late tourist registrations.

8. Account Registration

To use our service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access

9. Subscription and Payments

  • 14-Day Free Trial: New users receive 14 days free with full functionality. Card details are collected at signup but not charged during the trial period.
  • Billing: Subscriptions are billed monthly or annually as selected
  • Automatic Renewal: Subscriptions renew automatically unless cancelled
  • Refunds: We offer a 14-day money-back guarantee for first-time subscribers
  • Price Changes: We will notify you 30 days before any price increases

10. Acceptable Use

You agree NOT to use GuestBuddy to:

  • Violate any laws or regulations
  • Transmit harmful, offensive, or misleading content
  • Impersonate others or provide false information
  • Attempt to gain unauthorized access to our systems
  • Use the service for spam or unsolicited communications
  • Reverse engineer or attempt to extract source code

11. Content Ownership

  • Your Content: You retain ownership of property information and content you provide
  • License to Us: You grant us a license to use your content to provide our services
  • Our Content: GuestBuddy, its logo, and service design are our intellectual property

12. Guest Data and Compliance

If you collect guest data through our check-in forms:

  • You are responsible for complying with local guest registration laws
  • You must have a lawful basis for collecting and processing guest data
  • You must inform guests about how their data will be used
  • We act as a data processor on your behalf

13. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with advance notice
  • Temporarily suspend service for emergency maintenance
  • Modify or discontinue features with reasonable notice

14. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you:

  • Violate these Terms of Use
  • Fail to pay subscription fees
  • Engage in fraudulent or harmful activity

15. Governing Law

These Terms are governed by the laws of Croatia. Any disputes shall be resolved in the courts of Croatia, unless otherwise required by consumer protection laws in your jurisdiction.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through our service. Continued use after changes constitutes acceptance.

17. Acceptance of Terms

By creating a chatbot, you confirm that you have read, understood, and fully accepted these terms of service.

If you do not agree with any part of these terms, do not use the service.

2. Beschreibung des Dienstes

GuestBuddy bietet einen KI-gestützten Chatbot-Service für Ferienunterkünfte. Unser Service umfasst:

  • Anpassbare KI-Chatbots für die Gästekommunikation
  • Digitale Gäste-Anmeldeformulare
  • Mehrsprachige Unterstützung
  • Verwaltungs-Dashboard für Eigentümer
  • eVisitor-Integration (optional - Kroatische Touristenanmeldung)

3. Art des KI-Dienstes

GuestBuddy verwendet fortschrittliche KI-Technologie zur Generierung von Antworten für Gäste. Es ist jedoch wichtig zu verstehen:

  • KI generiert Antworten basierend auf Informationen, die Sie in das System eingeben
  • KI ist sich der tatsächlichen Bedingungen NICHT bewusst - sie weiß nicht, ob Dinge vorhanden sind, ob die Klimaanlage funktioniert, ob Warmwasser vorhanden ist usw.
  • KI kann "halluzinieren" - Informationen generieren, die überzeugend klingen, aber nicht korrekt sind
  • KI kann menschliche Überprüfung und Kommunikation nicht ersetzen
  • Die Qualität der Antworten hängt von der Qualität der von Ihnen bereitgestellten Daten ab

4. HAFTUNGSAUSSCHLUSS FÜR KI-ANTWORTEN

GuestBuddy GmbH ("Dienstanbieter") GARANTIERT NICHT die Genauigkeit, Vollständigkeit, Eignung oder Zuverlässigkeit von KI-generierten Antworten.

KI kann ungenaue, unvollständige, veraltete oder unangemessene Informationen generieren. Der Dienstanbieter LEHNT AUSDRÜCKLICH JEGLICHE HAFTUNG AB für:

  • Ungenaue Informationen über Unterkunft, Preise, Verfügbarkeit oder Bedingungen
  • Falsche Wegbeschreibungen oder Empfehlungen an Gäste
  • Jegliche Schäden, die aus dem Vertrauen auf KI-generierte Antworten entstehen
  • Verpasste Buchungen, Unzufriedenheit der Gäste oder negative Bewertungen
  • Verstöße gegen lokale Gesetze oder Vorschriften aufgrund ungenauer Informationen
  • Finanzielle Verluste jeglicher Art
  • Rufschädigung Ihrer Unterkunft

5. Ihre Verantwortung als Nutzer

Sie als Plattformnutzer und Eigentümer/Verwalter der Unterkunft übernehmen die VOLLE VERANTWORTUNG für:

  • Genauigkeit, Vollständigkeit und Aktualität aller Informationen, die Sie in das System eingeben
  • Regelmäßige Aktualisierung der Unterkunftsinformationen (Preise, Verfügbarkeit, Regeln)
  • Überprüfung, ob KI-Antworten dem tatsächlichen Zustand Ihrer Unterkunft entsprechen
  • Regelmäßiges Testen des Chatbots, um die Qualität der Antworten sicherzustellen
  • Bereitstellung korrekter Kontaktinformationen für Gäste bei Notfällen
  • Einhaltung lokaler Unterkunfts- und Tourismusgesetze
  • Verarbeitung und Schutz personenbezogener Gästedaten gemäß DSGVO

6. Haftungsbeschränkung

Im größtmöglichen gesetzlich zulässigen Umfang:

  • Der Dienstanbieter haftet IN KEINEM FALL für indirekte, zufällige, besondere, Folge- oder Strafschäden
  • Die Gesamthaftung des Dienstanbieters ist auf den Betrag begrenzt, den Sie in den letzten 12 Monaten für den Dienst bezahlt haben
  • Diese Einschränkungen gelten auch, wenn der Dienstanbieter auf die Möglichkeit solcher Schäden hingewiesen wurde

7. eVisitor-Integration

Wenn Sie die eVisitor-Integration zur Anmeldung von Touristen bei kroatischen Behörden nutzen:

SIE SIND ALLEIN VERANTWORTLICH für:

  • Genauigkeit der an das eVisitor-System gesendeten Daten
  • Fristgerechte Anmeldung aller Gäste gemäß gesetzlichen Fristen
  • Überprüfung, ob Daten erfolgreich gesendet und registriert wurden
  • Manuelle Anmeldung bei technischen Problemen mit der Integration

Der Dienstanbieter ÜBERNIMMT KEINE HAFTUNG für Bußgelder, Sanktionen oder andere Folgen, die aus ungenauen, unvollständigen oder verspäteten Touristenanmeldungen entstehen.

8. Kontoregistrierung

Um unseren Dienst zu nutzen, müssen Sie:

  • Mindestens 18 Jahre alt sein
  • Genaue und vollständige Registrierungsinformationen angeben
  • Die Sicherheit Ihrer Zugangsdaten wahren
  • Uns unverzüglich über unbefugten Kontozugriff informieren

9. Abonnement und Zahlungen

  • 14 Tage kostenlos: Neue Nutzer erhalten 14 Tage kostenlos mit voller Funktionalität. Kartendetails werden bei der Anmeldung erfasst, aber während der Testphase nicht belastet.
  • Abrechnung: Abonnements werden monatlich oder jährlich nach Wahl abgerechnet
  • Automatische Verlängerung: Abonnements verlängern sich automatisch, sofern nicht gekündigt
  • Rückerstattungen: Wir bieten eine 14-tägige Geld-zurück-Garantie für Erstabonnenten
  • Preisänderungen: Wir werden Sie 30 Tage vor Preiserhöhungen benachrichtigen

10. Akzeptable Nutzung

Sie stimmen zu, GuestBuddy NICHT zu nutzen für:

  • Verstöße gegen Gesetze oder Vorschriften
  • Übermittlung schädlicher, beleidigender oder irreführender Inhalte
  • Identitätsdiebstahl oder Angabe falscher Informationen
  • Versuche, unbefugten Zugang zu unseren Systemen zu erlangen
  • Nutzung des Dienstes für Spam oder unerwünschte Kommunikation
  • Reverse Engineering oder Versuche, Quellcode zu extrahieren

11. Eigentum an Inhalten

  • Ihre Inhalte: Sie behalten das Eigentum an Objektinformationen und bereitgestellten Inhalten
  • Lizenz an uns: Sie gewähren uns eine Lizenz zur Nutzung Ihrer Inhalte zur Bereitstellung unserer Dienste
  • Unsere Inhalte: GuestBuddy, sein Logo und das Service-Design sind unser geistiges Eigentum

12. Gästedaten und Compliance

Wenn Sie Gästedaten über unsere Anmeldeformulare sammeln:

  • Sie sind für die Einhaltung lokaler Gästemeldungsgesetze verantwortlich
  • Sie müssen eine rechtmäßige Grundlage für die Erhebung und Verarbeitung von Gästedaten haben
  • Sie müssen Gäste darüber informieren, wie ihre Daten verwendet werden
  • Wir handeln als Datenverarbeiter in Ihrem Auftrag

13. Dienstverfügbarkeit

Wir streben 99,9% Verfügbarkeit an, garantieren aber keinen ununterbrochenen Dienst. Wir können:

  • Geplante Wartungen mit Vorankündigung durchführen
  • Den Dienst für Notfallwartungen vorübergehend aussetzen
  • Funktionen mit angemessener Vorankündigung ändern oder einstellen

14. Kündigung

Sie können Ihr Abonnement jederzeit kündigen. Wir können Ihr Konto sperren oder kündigen, wenn Sie:

  • Diese Nutzungsbedingungen verletzen
  • Abonnementgebühren nicht bezahlen
  • Betrügerische oder schädliche Aktivitäten ausüben

15. Anwendbares Recht

Diese Bedingungen unterliegen kroatischem Recht. Streitigkeiten werden vor kroatischen Gerichten beigelegt, sofern Verbraucherschutzgesetze in Ihrer Gerichtsbarkeit nichts anderes erfordern.

16. Änderungen der Bedingungen

Wir können diese Bedingungen gelegentlich aktualisieren. Über wesentliche Änderungen werden wir Sie per E-Mail oder über unseren Dienst informieren. Fortgesetzte Nutzung nach Änderungen gilt als Zustimmung.

17. Annahme der Bedingungen

Durch die Erstellung eines Chatbots bestätigen Sie, dass Sie diese Nutzungsbedingungen gelesen, verstanden und vollständig akzeptiert haben.

Wenn Sie mit einem Teil dieser Bedingungen nicht einverstanden sind, nutzen Sie den Dienst nicht.
